1. Site operator
This website and the MindStim service are operated by MindStim Società a Responsabilità Limitata Semplificata (hereinafter also «MindStim SRLS» or the «Company»), with registered office at Via Trento 27, 64014 Martinsicuro (TE), Tax ID and VAT number 02223570678, registered with the Companies Register under REA no. TE-220240, share capital € 4.950,00 i.v..
For any communication relating to the service or legal obligations, the Company may be contacted at certified email (PEC) mindstim@pec.it or email address mindstimsrls@gmail.com.
2. Nature of the service
MindStim is online software for managing bilateral stimulation (BLS), with recording, transcription and summary tools. The person running the session can control the stimulus and share it through a dedicated link with real-time synchronisation.
The software is open to professionals, people with relevant experience, students and private individuals, including those without a VAT number. Anyone can obtain it for study, learning and lawful non-clinical use: running a professional practice is not a requirement for creating an account or purchasing a subscription.
MindStim does not replace clinical judgment, training or the user’s responsibilities. Purchasing the software does not confer a healthcare qualification. Use for diagnosis, psychotherapy, EMDR therapy or other regulated activities requires the qualifications, competence and compliance required by the laws where the activity is carried out.
The service can be purchased for professional or personal purposes. Consumer status and tax obligations depend on the actual circumstances of the purchase and applicable law, not solely on whether a VAT number is provided.
3. Terms of use
Access to and use of the site and service imply acceptance of this legal notice, the privacy policy and the cookie policy.
When creating an account, acceptance of this legal notice and confirmation of having read the privacy notice take place via a dedicated checkbox. The Company records the date, time and version of documents accepted for evidential and accountability purposes.
The user undertakes to use the service lawfully, not to compromise its security or availability and not to use it for unlawful purposes or purposes contrary to public order.
The Company may suspend or limit access to the service for maintenance, security or updates, with a duty of care to restore availability.
3.1. Subscriptions, free trial, renewal and refunds
For plans that include a 14-day free trial, the trial duration, the price that applies after the trial, the billing frequency and the cancellation method are clearly shown before activation. At the end of the trial, the subscription automatically renews at the stated price and frequency unless it is cancelled before the trial ends.
The user may cancel the subscription at any time through the billing portal available in their account. Cancellation prevents future charges and, unless stated otherwise at purchase, paid features remain available until the end of the already-paid period or free trial.
Subject to the consumer’s right of withdrawal and other mandatory legal rights, refunds are not provided after the charge following the free trial for a change of mind or for an unused portion of an already-paid period. Remedies for unauthorised or duplicate charges, billing errors or a service that is not as described remain available.
For consumers covered by the Italian Consumer Code, the ordinary withdrawal period for a distance contract is 14 days from its conclusion, subject to statutory extensions and exceptions. Merely accessing the software does not automatically waive the right of withdrawal. To exercise it, send an explicit statement to mindstimsrls@gmail.com or mindstim@pec.it, identifying your account and the relevant contract. Any refunds due are made within the deadlines and using the methods required by law.
4. Intellectual property
Texts, trademarks, logos, graphical interface, software code and site content are owned by the Company or respective licensors and are protected by applicable intellectual property law. Unauthorised reproduction, distribution or modification is prohibited.
5. Limitation of liability
The service is provided «as is», within the limits of available technology. Except where exclusion is not permitted by law, the Company is not liable for indirect damage, loss of profit or interruption of professional activity arising from use or inability to use the service, nor for how the professional uses the tool within their clinical practice.
The professional remains solely responsible for therapeutic choices, informed consent, verification of technical requirements on the patient side and compliance with applicable law.
6. External links
Any links to third-party sites are provided for convenience. The Company does not control nor is responsible for the content of such sites.
7. Governing law and jurisdiction
This legal notice is governed by Italian law. For any dispute relating to the interpretation, validity or performance of this document, unless otherwise required by mandatory consumer protection rules, the Court of Teramo shall have exclusive jurisdiction.
